updat on defender sale/ scam

not shure if this is wher to post this if not feel free to delete.
my defender #14 for sale was sold by harrison imports in centerville utah
the new owner has left with the truck and the dealer has delayed payment to me and not
shure if they will pay at all. they have made several promises but no wire transfer
i have given them one more chance to produce the money or the car by 10 am tomorow
or i will file a complaint with the state and a claim against their surety bond.
I know they sell alot of landrovers as they came from a landrover dealership
any thoughts on what to do next ?
anyone els ever deal with them ?
when they worked for landrover i purchest several cars from them including a new lr3 and a new rangrover.
things must be tough enough they are forced to conduct biz this way now that they are out on their own.

So, you sold you truck on consignment and they kept the money? I would file a police report and report the car stolen. Have the police pick it up from the new owner and return it to you.

What reason could they have for not paying you? Another option would be to find the slimiest attorney and have him sue them damages, fraud and everything else you can think of. Plus, make sure you do not have to pay the commission to the either.

But, I would get the truck back and maybe do a private sale with the new owner.

yes i have dealt with the owner and mngr part of the deal was if they bought it outright i would take
a credit for 5k towards a latter purches of a 04 disco, rangrover for my doughter or a bmw motorcycle . at the last min they want the credit only on a new 1200 bmw and to be don by the end
of the year and at list price. this would most likely be to keep from paying me and make payment with somthing they have in stock with no chance of selling for some time.

i just had to add the credit was if they bought it outrght and made the deal that day and not whaighted to sell it
they are telling me they have not been paid yet. my thoughts are if they let the car go without payment
how or where they get the money is not my problem.

Did you ever figure out what the deal was with the low AutoCheck score?

I saw over the weekend it was gone from their site. Did they even tell you what it sold for?

never did get the police report but i can be shure it has never had any paint work.
all it says is that it was in a acident but title is clear

What kind of consignment arrangement did you agree to?
I would carefully look at your paperwork and contact your attorney.
They would never let the truck go unless they had full payment.

That they deny they have been paid is a load of bs.

did you release/transfer the title before you received payment? (not a good idea). If not and truck was sold, file a police report/claim of theft, get the report, file criminal charges and file law suit thereafter.
Make sure that anything you do does not exceed statutes of limitations.

Something doesn't look right about this post.
I don't think we have the full story and I don't believe anyone with this terrible grammar/punctuation/spelling could afford an LR3 or an RR.

I'm not familiar with this dealership, but if they're like any other car dealership in today's economy, they may be becoming insolvent. If that's the case, they may be filing for bankruptcy protection in the near future. If that happens, your chances of getting your money may not be so good. I'd recommend you consult an attorney....sooner rather than later.

As long as he has something in writing, as a secured creditor, he'd have priority over the bankruptcy creditors. That's why I asked earlier what he had in writing.... If he doesn't have any agreement in writing, the case gets interesting.

If he has nothing in writting, he is AHEAD OF THE GAME and can be a royal a-hole towards the dealer.

Meanning, no contract, Dealer sold D90 without permission and / or agreed amount, so owner can file against surety bond for " THE AMOUNT ;-) " and Bankrutcy will have nothing to do unless , they did not pay their Insurance bond.

Check their status with UT Dealers Licensing Department

Guess you haven't been around some of the non-native english speakers that I have. Some of them came here with more money than I can even imagine having access to. Others just work hard and can and do buy all manner of expensive toys.

It is that "style speak" where all the rules of proper grammar and spelling give way to showing how cool you are. Glib little snippets of sentences with stylistically misspelled words generally say F-you to effective communication.
