Then they may have an issue with their wording.. Nene overland acquires Berkshire land rover... Not just their parts.

I don't understand why Nene would advertise its acquisition of BLR. Does BLR not have the reputation elsewhere that it does in the USA (or on this forum) ??

How can you purchase the assets of a company when they have outstanding liabilities? Those parts should be liquidated to reimburse the creditors..

No chapter 11 in UK. Receivers get called in to liquidate assets.
Parts and name are assets.

I don't know about the brakes, only their unreliability.

While there is no ch 11 bankruptcy in the UK nor any licensing requirements for a used car dealer (scary), it is illegal to trade when you know you are insolvent. Obviously Mogford knew.

I have known Andrew the owner at Nene for several years.
From the horses mouth. In addition to the inventory, Nene-Overland purchased the BLR name, brand, database, website and all the shop equipment and garage in UK. Nene now has control of the brand so the former cannot re-open under the same name.
This was a business opportunity that was recognized to develop the business closer to London. They will reestablish the site and dominate it with NENE and Icon branding. Smart thing to do in my opinion.

Look at it this way. He is putting a parasite company in the grave.
Its unfortunate that there are many who have lost money to the former owners. I have lost hundreds of thousands to a parasite as well.

Nene is not trading under the BLR name. For complex reasons the site will continue for a period under the BLR name until such time arrives to eliminate that brand. However the company is now being run by a business that has been trading under the same name (Nene OVerland) since 1988.

By purchasing a business does not mean they are responsible for the disreputable business practice done previously.

Andrew should be made well aware of Tommy's situation and he should consider making Tommy whole.

If Andrew truly did buy BLR business intangibles like brand rights, trade names and customer data then a court might say Nene owns the good and the bad that went into creating those business intangibles.

Tommy's case dates back quite some time and is one of several. IE this has been going on for years and many have been scammed.

In the beginning, I was sent photos of two different 110's that Kieron said belonged to me, I would like to know what happened to the trucks, and the parts they sent me pictures of? Now, with all that is going on with the importation of these vehicles, I could never get a truck here from what I understand?
