that was a verbal conversation. My actual letter is posted above feel free to contact the Atty. Its my understanding that LRNA holds the same pattents in Canada and the same wave of letters has gone out there.

Just to clear any questions up in this thread, we hold two agreements with Land Rover and due to this we are able to continue on as Rovers North. There are still boundaries we are not allowed to step over, and we try our best not to.

Every one is changing there names to get out of the way of LRNA....how ever I must say there lawyer was a very nice lady. Really enjoyed our chats generally a very nice person. I think only one left with Rovers in the name is RN and there they have a very old agreement with LR.

Interesting that they conveniently ignore the Freelander in Paragraph ten.

A friend of mine runs a land rover / range rover specialty repair shop. Based on his experience, they are capable of stopping anywhere, anytime, at any cost.

I don't know about the brakes, only their unreliability.

Somehow changing the name to Freelander 4x4 just doesn't do it for me.

ROAV's Letter from LRNA - Urban Legend?

Back when Land Rover left North America, Sandy Grice (President of ROAV) sent an official letter to LRNA asking for rights to the Land Rover usage and logo.

LRNA replied with a letter and agreed saying they would not be back in North America.
Sandy has since lost track of the letter, but he showed it to me in about 1989 when we bought a IIA Station Wagon. Sandy. Diesel Bob McCullough, Mike McCaig, myself, and a few others worked to revive ROAV.

After spending a total of 14 years serving ROAV, I am not even a member now.
Just don't have the time.

Welcome Derek & Catherine and good luck with Green Mountain (4X4 perhaps ?).

Ouch, they are seeking triple damages on basically all profits earned while using the trademarks ((or from the time they sent the cease & desist order, I cant tell which) and attorneys fees (which you can imagine will be extensive as a global company wouldn't be using a cheap, local firm). That judgement would basically level anybody.

It sounds like LRNA simply wants shops to stop using Rovers and is not out looking for blood.....unless you stick your middle finger up at them as this Washington business did......then watch out!

If you developed software and were marketing it as "MS...whatever" and were using a logo that was similar to Microsoft's, you'd better beleive that you'd be shut down in a hurry. Why would trademarks be any different for the automobile industry?

the truth is that only in the age of internet advertising, websites and social media would this even be a problem. Imagine what it would take for LRNA to ferret out all the shops using "Rover" or some varied image of the green oval if shops did'nt have a website promting these images? It would probably never happen at all. I bet there are a ton of old-time small shops in every corner of the US (and the world) that use some variation of the green oval as a sign and/or "Rover" in their name and they never get "the letter". I also bet that's because they are tucked away in remote corners and run by ole-school folks who don't advertise or have a web-site.
Just saying, you want to run with the big dogs and put yourself out there with promotion etc., then this is what happens.

One thought did occur to me though........do you think NASA received a letter for their use of "Rover" in the Lunar Rover?

I thought it was super silly for LRNA to do, but upon further thought, there are no repair or car shops in town that are not official dealers with big company names...no "Joe's Ford Lab or Ford Barn"....yes "Joe's Speedshop"....etc. My guess, LRNA is just late to the table.

Sad because we like the people behind the old names. And they were/are pretty cool names.

My favorite car shop name is a Porsche shop in California: S Car Go. T-shirt has a snail as the motif.

That is a fairly standard trademark infringement complaint and request for relief. The fact that the shop has a lousy reputation just strengthens the dilution/tarnishment claim. That claim would have been included regardless of the shops reputation.

I'm sure the infringing party ignored several cease and desist letters.

If a third-party might think you are owned or affiliated with Land Rover based on the name of your company, you are arguably infringing LR's trademark.

Well you got away with it for a year and a half. We told you it would happen in Sept 2011. You had a good run . I would have thought Ms. Letu would have found you out quicker.

I should have listened in he beginning...learned my lesson there. Mrs Letu was very nice. Se have up 6 months to change all the paper work and website over. Never was hostile at any point and very understating. I can not say enough good things. Also very funny lady.
