So, the government (Prosecutor) is forced to mediate with the plaintiffs. The judge has shown that the government case is weak.

This mediation is a negotiation where each side has goals and interests. In particular the prosecutor will need to save face by getting something from the negotiation. Looking at it from the HR point of view, his supervisor will be applying a performance review at some point. So the prosecutor has to show something for the effort and cost put into persecuting the victims/prosecuting the "bad guys". He'll also want something for a press release announcing victory against "illegal" vehicle importation.

So what is the minimum outcome acceptable to the government position that allows the prosecutor to walk away with a "win"? I suspect it will be return of the vehicles without compensation. No acceptance by the government of their wrongful seizure. Trucks will come back dirty but free of storage charges. Any damage caused by being towed will be disavowed and owners told to sue the towing company.
Victory will be proclaimed by the government due to the "message" sent to all those attempting to bring in non-conforming vehicles.


But, despite above, I am hoping for the best possible outcome, which includes compensation for Will for his efforts. Not to mention, some sort of lawyers' organization professional award for taking on Justice/DHS.

Interesting position to be in. Of course the return of the vehicles to the rightful owners is the #1 objective here. However its unfortunate that accepting the terms of a mediation will prevent this from reaching the level where the Government's wrongdoings are fully exposed and case law could be established.

From a macro perspective, this case could finally be the edge to pry on to expose the 25 year law as ludicrous. But that would entail an awful lot of pain, suffering, and effort by our man Will

I'm guessing that the warrant for the civil seizure was written before they even knew my truck had already been seized from Dr. Aarons. Since they just raided his business and indiscriminately took whatever they pleased, including my truck, and didn't really sort through the booty completely for months.

I suppose I'm lucky that my VIN ended up on the list.... It might be what saves Big Red.

The government will likely be looking for a gag order on all of us involved in the defense so the negative publicity stops. The govt is also seeking to keep the judge from deciding the case given the defense Will has presented so that case law isn't established for the future.

That said, what will likely be posted here, if it goes that way, is simply that a settlement was reached and nothing more. IE a positive outcome with no explanation as to how or why.

Citizens talking shit about the government, oh no!

Honestly if it comes to stopping the negative publicity, sorry guys but they can keep the trucks.
