Ok I went thru the 19 pages of the What's legal thread. Nowhere did I see where Danny posted to that thread. So I've posted up here where in the past he has read and posted.

It's interesting that the text claims "the defendants gave not pursued discovery in an expeditious manner." While the elapsed time fits that description, certainly the number of claimants and the complexity of just the facts relating to the vehicles in question makes the prolonged discovery more reasonable? I don't know, but at least you got what you wanted. Good job.

Also, I like how you've introduced the concept of the definition of "is" by approaching the modification topic. Do you think there is a potential to shape better agency rule-making here or is that point purely intended to show that the govt doesn't even understand what it is enforcing?

Part of what is going on here is that if this does go to trial and the judge rules is that there will be
established case law going forward. Credit where credit is due, Will is a crafty fellow and there is light @ the end of the tunnel.

Update:

In light of the court's most recent order (which I posted here a short time ago), the government has now expressed its desire to pursue mediation in our case. A motion has been filed by the parties and we await the court's order for referral to ADR (alternative dispute resolution) on the matter.

This being said, please do not read too much into this statement. No resolution of the issue has been reached yet. It simply indicates a change in the government's direction. I otherwise plan to continue on with business as usual, beginning with conducting the depositions of certain government agents next month.

I will continue to keep the community informed as best I can, when I can.

US vs the Defenders would be wise to avoid court because once a judge rules then there is established case law going forward.
Given some of the arguments Will is putting forth that wouldn''t be a good thing for them if he were to win.
