That PDF is a warrant for arrest in rem. This means that the property is to be seized/forfeited. By definition, the defendants cannot be people. However, just because the defendants are property doesn't mean the property itself is committing a crime.

Ray is right, and I think as Americans we lose site of what these words encompass. Bravado is cheap. Painting a picture that sounds like Poland in 39 drives the emotions. At the same time, we tend to lash out when we feel we have been violated. Losing a loved vehicle to something like this is more than just a material loss. The collective effort of this forum impresses me to no end, and I imagine that is why we keep fixing these stupid trucks.

Yes, I know the 3rd vehicle I was representing is also with its owner. I was only representing 3 of the 6 that were dismissed. So, you other 3 owners are welcome!! (whoever you are!!)

In addition, from what I was told by the AUSA, the other 3 Rovers that were dismissed were so completely torn apart, that the DHS agents who were executing those seizures actually didn't take them into custody. That is to say, at least as I understood it, they didn't take them because they really didn't know logistically how to collect and move all the parts.....

...........or maybe they just didn't want to!

Nope. In order to regain your property and export it you have to sign a hold harmless letter or they won't let you ship it out.

Quick Update:

I just wanted to let everyone know that I filed a Motion to Dismiss this past Monday as well as the Answer to the Complaint for all 19 of the parties that I am representing. The government has until Monday Sept. 8 to respond to the motion.

I'll be sure to update what I can, when I can, from here going forward. In the mean time, my thanks go out again to everybody for their support!
