Offer to give it back if he finds you a replacement plus a little pain and suffering. If money is not the issue to him.

My guess is they are keeping more of your money then he would like to allow. I can offer your D90 sanctuary in KS if it becomes necessary.

WTF? If there is a valid title in MD what the hell is VA doing issuing a duplicate of an out of date title! Sounds like a SNAFU at the VA DMV.

Hows that for an over-use of abbreviations!

Hopefully you have your truck securely stored.

A worst case scenario: Seems remotely plausible that armed with the MD title (and the right sympathetic ear from the authorities) perhaps the argument could be made that the vehicle should go back to the original owner until everything is sorted out. Possession is everything...

The DMV title squabble may be the dealer's problem; but it might be worth your while to consult an attorney to find out how best to protect your rights as a consumer who made a purchase in good faith.......just in case.

I already have an attorney on retainer

As for the title, I titled the vehicle with a SIGNED valid, current title. The guy went to his DMV afterwards and applied for a duplicate stating that he "mis-assigned" it!

As for the truck, I have it secured in an undisclosed location and it is immobillized until this is resolved. Plus I have safe full of guns....

It was MD that gave the guy a dup title. I can only assume the transfer of ownership didn't show up on their computer fast enough, especially since it was then titled in another state.

When you apply for a duplicate title in PA you have to sign something saying you never sold the truck or anything like that. I wonder what MD's form says . . . .

I just checked the MD DMV website to see how this guy could have got a duplicate title (see attached pic). He would have to turned in the OLD title if he reported "misassigned, torn, or damaged." The only way they would have given him a new title is if he reported the title Lost or Destroyed. Funny, since I used the orignal title to title it in VA.

I just applied for a duplicate title on the truck also. Soon it will be mine.
